TL;DR:
- Civil penalty: The U.S. District Court ordered $45.15 million in fines and $228.58 million in joint restitution against Eddy Alexandre and his platform.
- Capital raised: The entity raised more than $262 million by promising weekly returns of up to 9.99%, while accumulating real trading losses exceeding $49 million.
- Judicial recovery: The court-appointed receiver has returned over $98 million to more than 28,000 investors as of the July 2026 balance report.
The United States District Court for the Southern District of New York entered a final civil judgment against the operators of the EminiFX Ponzi scheme, resolving the lawsuit filed by the CFTC. The court order secures financial remedies and permanent operational bans against the firm’s founder, Eddy Alexandre.
The ruling, signed by U.S. District Judge Valerie Caproni and formalized on October 8, imposed a $45.15 million civil monetary penalty on the defendants. The judgment confirmed the joint and several liability to pay $228.58 million in restitution to the victims, along with a $15.05 million disgorgement order assessed exclusively against Alexandre.
According to the CFTC report, payments made toward the primary restitution will be credited directly to reduce the individual disgorgement obligation, preventing double recovery of funds. Court documents specify that investor claims will hold strict priority over the collection of the government civil penalty when distributing receivership assets.
EminiFX launched commercial operations in late 2021, marketing a private investment club offering access to forex and crypto markets through a tool promoted as the Robo-Advisor Assisted Account (RA3). Case records show the company promised users guaranteed weekly returns ranging from 5% to 9.99%.
Regulatory forensic reports confirmed that these operations were not supported by actual financial profits. The company recorded net trading losses exceeding $49 million during its eight months of operation, while Alexandre demonstrably misappropriated at least $15 million into personal bank accounts and personal investment vehicles.

The Judicial Restitution Process and Criminal Sanctions
Federal investigations determined that the platform used deposits from new participants to satisfy withdrawal requests from earlier users. According to data presented by federal prosecutors, more than 25,000 participants contributed funds under falsified financial representations prior to the official legal intervention in May 2022.
The court appointed a receiver tasked with locating, liquidating, and distributing the corporation’s remaining assets. Figures provided by the CFTC indicate that, as of July 2026, this process has returned more than $98 million to over 28,000 investors enrolled in the claims process.
The regulatory agency highlighted in its statement that a court order for monetary restitution does not guarantee full recovery of reported losses. Technical reports note that total recovery remains contingent upon the actual liquidity and seized assets available from the wrongdoers.
This civil measure complements the criminal conviction handed down against Alexandre in the Southern District of New York, where the defendant pleaded guilty to commodities fraud. As a result of these actions, the federal court imposed a sentence of 108 months in federal prison (nine years of incarceration) and ordered $213 million in criminal forfeiture.
The injunction permanently prohibits Alexandre and EminiFX from soliciting funds, managing third-party accounts, or engaging in trading activities on markets governed by the Commodity Exchange Act.
The civil case will remain officially open in federal court as the court-appointed receiver executes the scheduled phases of the distribution plan to creditors throughout the final quarter of 2026.
