TransparentBusiness Inc., which does business as Unicoin, filed a complaint on September 8 in the U.S. District Court for the Southern District of New York against Universal Navigation Inc., doing business as Uniswap Labs. Unicoin seeks declarations that its UNICOIN mark does not infringe or dilute Uniswap’s UNI, UNISWAP or UNICHAIN marks.
The complaint says Uniswap’s counsel sent demand letters on June 3, July 17 and August 14 alleging trademark infringement, dilution, cybersquatting and unfair competition. Unicoin is also asking the court to rule that its unicoin.com and unicoin.org domains do not violate federal anti-cybersquatting law and to cancel Uniswap’s federal UNI trademark registration.
The dispute is now before the court, and no ruling has been issued on Unicoin’s requests. The next step is whether the court accepts Unicoin’s arguments that its branding and domains can coexist with Uniswap’s marks and whether the UNI registration should remain in force.
