A federal judge in New York on Tuesday denied Sam Bankman-Fried’s request for a new trial, rejecting his argument that newly discovered witnesses could provide exculpatory testimony. ABC13 reported that Judge Lewis Kaplan called the claim baseless and said Bankman-Fried already knew the three witnesses before trial.
The ruling matters because it shuts down Bankman-Fried’s latest effort to challenge his conviction in the FTX fraud case. According to ABC13, Kaplan said none of the witnesses was actually newly discovered and that Bankman-Fried could have tried to obtain or compel their testimony before trial, but did not. The judge also said there was no evidence the witnesses would support claims that FTX was not insolvent or that victims were fully compensated in bankruptcy.
The next point to watch is whether Bankman-Fried pursues another appeal route. ABC13 said he remains in prison serving a 25-year sentence after being convicted on seven counts of fraud, conspiracy and money laundering, and was also ordered to forfeit $11 billion for victim compensation.
