{"id":152685,"date":"2023-09-19T05:54:07","date_gmt":"2023-09-19T05:54:07","guid":{"rendered":"https:\/\/crypto-economy.com\/?p=152685"},"modified":"2023-09-19T10:27:38","modified_gmt":"2023-09-19T10:27:38","slug":"judge-denies-secs-request-to-inspect-binance-us-software","status":"publish","type":"post","link":"https:\/\/crypto-economy.com\/judge-denies-secs-request-to-inspect-binance-us-software\/","title":{"rendered":"Judge Denies SEC\u2019s Request to Inspect Binance.US Software"},"content":{"rendered":"<p style=\"text-align: justify\">In the latest developments to the <a href=\"https:\/\/crypto-economy.com\/binance-exchange-review-complete-guide\/\" target=\"_blank\" rel=\"noopener\">Binance<\/a> vs SEC trial, <strong>the judge has denied the federal regulator\u2019s request to grant immediate access to Binance.US software<\/strong>.<\/p>\n<p style=\"text-align: justify\"><!--more--><\/p>\n<p style=\"text-align: justify\">According to the September 18 Bloomberg <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-09-18\/sec-fails-to-win-immediate-inspection-of-crypto-exchange-binance-us-software?srnd=premium#xj4y7vzkg\" target=\"_blank\" rel=\"noopener\">report<\/a>, Judge Zia Faraqui asked the Securities and Exchange Commission (SEC) to be specific with its information request and denied its request to gain access to Binance.US software as the <strong>SEC claims that the embattled exchange is not cooperating with the investigation.<\/strong><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The SEC failed to win immediate access to inspect Binance US software in ongoing lawsuit against crypto exchange <a href=\"https:\/\/t.co\/frYUbaqVwB\" target=\"_blank\">https:\/\/t.co\/frYUbaqVwB<\/a><\/p>\n<p>&mdash; Bloomberg Crypto (@crypto) <a href=\"https:\/\/twitter.com\/crypto\/status\/1703917678874841395?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">September 18, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h2 style=\"text-align: left\">The Caffu Custody Solution is The Reason For The Dispute on the Binance.US Case<\/h2>\n<p style=\"text-align: justify\">As <a href=\"https:\/\/crypto-economy.com\/sec-claims-binance-us-level-of-corporation-is\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> on Crypto Economy, in an <strong>August 14 filing, the SEC accused Binance.US of not cooperating in the ongoing investigation<\/strong> and failing to produce essential witnesses for a deposition despite agreeing to a June 17 consent order <em>\u201cto provide expedited discovery and other relief relating to the custody, security, and availability of U.S. customer assets and those of BAM itself.\u201d<\/em><\/p>\n<p style=\"text-align: justify\">The filing reads:<\/p>\n<p style=\"text-align: center\"><em>\u201cIt has responded to requests for relevant communications with blanket objections and has refused to produce documents kept in the ordinary course of its business, claiming those documents do not exist, only for the SEC to later receive such documents from other sources.\u201d<\/em><\/p>\n<p style=\"text-align: justify\">Per the filing, Binance\u2019s parent company, <strong>BAM, has only provided 220 documents during the discovery process<\/strong>, many of which consist of unintelligible screenshots and documents without dates or signatures. The SEC further noted that the exchange<strong> had agreed only to four depositions of witnesses, which it unilaterally deemed enough.<\/strong><\/p>\n<p style=\"text-align: justify\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-140974 size-full\" src=\"https:\/\/crypto-economy.com\/\/wp-content\/uploads\/2023\/06\/SEC-Vs-Binance-e1686728816715.jpg\" alt=\"Custody Solution Caffu is the Bone of Contention\" width=\"825\" height=\"328\" srcset=\"https:\/\/crypto-economy.com\/\/wp-content\/uploads\/2023\/06\/SEC-Vs-Binance-e1686728816715.jpg 825w, https:\/\/crypto-economy.com\/\/wp-content\/uploads\/2023\/06\/SEC-Vs-Binance-e1686728816715-300x119.jpg 300w, https:\/\/crypto-economy.com\/\/wp-content\/uploads\/2023\/06\/SEC-Vs-Binance-e1686728816715-768x305.jpg 768w, https:\/\/crypto-economy.com\/\/wp-content\/uploads\/2023\/06\/SEC-Vs-Binance-e1686728816715-18x7.jpg 18w\" sizes=\"(max-width: 825px) 100vw, 825px\" \/><\/p>\n<p style=\"text-align: justify\">In a September 12 filing, Binance operator Bam Trading characterized these SEC\u2019s discovery requests as \u201c<em>overly broad, unduly burdensome\u201d<\/em> and \u201c<em>beyond the scope of the consent order.\u201d<\/em><\/p>\n<p style=\"text-align: justify\">The custody of Binance.US customer assets is one of the central concerns that the SEC has with the cryptocurrency exchange, and <strong>Binance.<\/strong><strong>US\u2019s use of Caffu, a wallet custody solution by the global entity of Binance, is the center of the dispute.<\/strong><\/p>\n<p style=\"text-align: justify\">According to the August 14 filing, Caffu appears <em>\u201cto have control of Customer Assets through their role in the establishment of wallets and keys shards related to BAM Customer Crypto Assets,\u201d<\/em> and thus violates a prior agreement meant to prevent funds from being diverted abroad.<\/p>\n<p style=\"text-align: justify\">The US SEC asked the court to grant them access to Binance.US software, which the judge refused by saying he was not <em>\u201cinclined to allow the inspection at this time.\u201d <\/em>He asked both parties to keep things moving by urging the SEC to narrow down its request for information but allowing it to depose more witnesses.<\/p>\n<p style=\"text-align: justify\">The judge also asked Binance to provide more information about its relationship with Caffu.
